The Wisconsin Academy of Sciences, Arts &amp; Letters just named Lester Pines “one of sixteen Wisconsinites who have demonstrated a lifelong commitment to intellectual discourse and public service to receive the 2026 Fellows Award.”

The Academy notes, “The Fellows Award recognizes educators, researchers, mentors, artists, and civic or business leaders from across Wisconsin who have made significant accomplishments in their fields and substantial contributions to the cultural life and welfare of the state and its people.  Established in 1982, the Fellows program is the only award that recognizes outstanding work across the sciences, arts and letters in Wisconsin.”

“Since its founding in 1870,” the Academy notes “it has been dedicated to the belief that the health of our state depends on the free exchange of ideas. The Academy Fellows program is the heartbeat of this mission, serving as the common ground where Wisconsin’s most influential thinkers, creators, and problem-solvers meet. These individuals are the modern stewards of the Wisconsin Idea.”

Fellows are selected by committee through a rigorous process every two years and will be inducted at a ceremony in the Fall of 2026.

In addition to Lester, a practicing attorney for his entire 50 year career, other attorney Fellows include: Wisconsin Supreme Court Justices Shirley Abrahamson &amp; Janine Geske; UW law professors Alta Charo &amp; Willard Hurst; &amp;, long-time elected member of Congress, Rep. Henry S. Reuss.

The Academy’s press release described all new Fellows, saying of Lester, “Pines is a titan of the Wisconsin legal community whose career has been defined by a fierce commitment to constitutional rights and the public good. Pines is a founding partner of Pines Bach LLP and a premier Wisconsin litigator. Upon his retirement in 2025, The Capital Times described him as a ‘great guardian of the Constitution, the rule of law and justice.’"

“His career-long commitment to civil engagement was evidenced as early as 1976 when, at the request of Governor Lucey, he negotiated a peaceful resolution to an armed prison uprising, an act for which he was hailed as a ‘courageous Madison attorney.’"

“Throughout his tenure, three Wisconsin governors have sought his counsel. Governor Doyle noted that Pines ‘fought for and furthered the highest values of this country,’ while Governor Evers stated that ‘human rights and civic engagement are what Lester Pines is all about.’ His reputation reached the national stage when President Obama asked him to represent a friend’s son, later writing: ‘Having an attorney of your caliber looking out for him really made a difference.’"

“Pines won landmark policy cases before the Wisconsin Supreme Court, including maintaining the independence of the Superintendent of Public Instruction and defending the constitutionality of the state’s domestic partnership law.”

“Inducted as a Fellow of the American College of Trial Lawyers in 2005—an honor bestowed on only one percent of the state’s lawyers—he has also been recognized by the Madison NAACP and Fair Wisconsin. An Adjunct Professor of the Year at UW Law School, his civic leadership includes serving as president of the Jewish Federation of Madison and as a board member for the Urban League and the Madison Symphony.”

			                <content type="html" xml:base="https://www.pinesbach.com/blog/2022/01/madison-school-district-violates-labor-law-undermining-teachers-union/"><![CDATA[January 26, 2022:  Earlier this month, a hearing examiner for the Wisconsin Employment Relations Commission found that the Madison Metropolitan School District committed a “prohibited practice” by twice surveying employees represented by union Madison Teachers Incorporated about base wages in the period leading up to negotiations around pay for the 2021-2022 school year. That decision is now final. By order of the Commission, the District was required to share the decision with all of its employees represented by MTI, along with a notice signed by School Board President Ali Muldrow and Superintendent Carlton D. Jenkins, Ph.D., affirming that the District won’t violate the law again in the future.

It has long been held that a survey of union-represented employees on a mandatory subject of bargaining violates the duty to bargain with the employees’ chosen representative. Since Act 10 gutted the rights of Wisconsin public sector labor unions and their members, the only subject public sector employers, like school districts, must negotiate with labor unions on is “base wages.” After the District sent the first survey, MTI, through <a href="https://www.pinesbach.com/attorney/tamara-b-packard-custom/" data-wpel-link="internal">Attorney Tamara B. Packard</a> of Pines Bach LLP, filed its complaint with the Commission and warned the District against doing this again. Nevertheless, the District sent the survey a second time to those same employees.

Even more disturbing is that the District engaged in this same kind of behavior in the lead-up to negotiations for the 2020-2021 school year. MTI filed a prohibited practice charge then, too, which the parties settled based, in part, on the District’s commitment to respect MTI as the certified representative of the teachers, educational support staff, and substitute teachers employed by the District. In that settlement, the District also committed to bargain with MTI in good faith in the future. That settlement was reached in December 2020, yet less than 6 months later, the District engaged in the exact same illegal behavior.

As the hearing examiner explained in the January 2022 decision, this kind of behavior “is bypassing and undermining the labor organization selected by the employees to collectively bargain over that subject. It is the labor organization’s role to seek any needed employee input on a mandatory subject of bargaining—not the employer’s.”

Said Packard: “It is unfortunate that the public school district in Madison Wisconsin has engaged in a pattern of bypassing and undermining employee unions. Wisconsin’s public sector labor unions and their members have suffered greatly under decade-old union busting laws. Our local institutions and elected officials should not attempt to further silence the collective voice of its employees.” Added Jeff Knight, MTI Executive Director, “Doubly disappointing is that MTI and MMSD were able to jointly create an Employee Handbook that honors a good faith working relationship built on collaboration and consensus building. We hope this ruling persuades MMSD to return to that model for the good of its employees and the students they serve.”]]></content>

			                <content type="html" xml:base="https://www.pinesbach.com/blog/2021/04/pines-bach-attorneys-win-victory-blocking-unlawful-gop-redistricting-counsel-contracts/"><![CDATA[Pines Bach LLP attorneys won a significant victory for open, democratic government on April 29, as a Dane County court ruled that Republican leaders of the Wisconsin Legislature had unlawfully entered into contracts with private lawyers, at taxpayer expense, to aid their partisan redistricting efforts.  Pines Bach LLP, representing a group of taxpayers and teachers, sued the Republican leaders, seeking to have their contracts with private counsel declared void <em>ab initio</em> and to permanently enjoin them from spending any more public funds on the contracts.  The court granted summary judgment in Pines Bach LLP’s favor and awarded their clients all of the relief they had requested.

Like all states, Wisconsin is required to redraw its congressional and legislative districts every 10 years based on population changes reported by the U.S. Census Bureau.  Sometimes states have skewed their redrawn districts so as give one or more groups of people a built-in advantage in representation at the expense of others, an anti-democratic practice known as “gerrymandering.”  In 2011, the Republican majorities in the Legislature and then-Governor Scott Walker enacted a gerrymandered map so hyper-partisan in the advantage it gave Republicans that the Harvard Electoral Integrity Project scored Wisconsin’s boundaries as a 3 out of 100—the single lowest rating in the entire nation.  In this cycle, Governor Tony Evers has proposed to have the redistricting process directed by a non-partisan commission.  In addition, the legislature’s own full-time service agencies historically have provided the legal advice and technical work to translate policymaker directions into legal maps, and they remain capable of that work, whether in conjunction with a non-partisan commission or not.

However, Republican legislative leaders not only refused a non-partisan commission, but instead signed contracts with two private law firms to work with them to replicate their 2011 gerrymandering work in secret.  The requisite data from the Census Bureau will not be delivered for months, with the genuine work of redistricting beginning only then, and any potential litigation about the new maps commencing only after that work is completed.  Even so, the Republican leaders have already been paying $30,000 per month since January on one of their outside contracts alone, for pre-litigation “consulting” to enable their gerrymandering efforts.

Pines Bach LLP attorneys <a href="https://www.pinesbach.com/attorney/lester-a-pines-custom/" data-wpel-link="internal">Lester Pines</a>, <a href="https://www.pinesbach.com/attorney/tamara-b-packard-custom/" data-wpel-link="internal">Tamara Packard</a>, and sued after acquiring copies of these contracts.  They argued that statute specifically allows the Legislature to retain counsel at public expense in limited circumstances in which its interests are affected in a lawsuit.  By contrast, the law clearly does not allow individual, partisan legislative leaders to spend taxpayer funds on outside attorneys for their own secret consulting purposes when there is not yet even a lawsuit for those attorneys to work on.

The defendants, state Assembly Speaker Robin Vos and Senate Majority Leader Devin LeMahieu, claimed that both the Wisconsin Constitution and each of three separate statutes, Wis. Stat. §§ 13.124, 16.74, and 20.765, independently authorized the contracts.  However, Judge Stephen Ehlke ruled that none of the laws the defendants cited supported the contracts.  He noted that one of the statutes was passed in 2018 and that the Legislature could have enacted it then with the meaning they want it to have now, but that they chose not to do so.  And at any rate, he ruled, their proffered interpretations “impermissibly infringe” on the separation of powers provided for in Wisconsin’s constitution.

“Vos and LeMahieu have already lawlessly spent tens of thousands of taxpayer dollars on private lawyers for secret legal advice for a non-existent action, all to enable their gerrymandering,” Pines said.  “This misuse of taxpayer funds had to be stopped.  Hopefully they will learn their lesson and come to the redistricting process in an open, honest, and democratic way.”]]></content>
