Success for Planned Parenthood

CWPB partners Lester Pines and Susan Crawford, along with attorneys from Planned Parenthood of America and the ACLU Reproductive Rights Project, obtained a permanent injunction against a 2011 Wisconsin law that required physicians who provide abortion services to have admitting privileges at a hospital within 30 miles of where those services are performed. U.S. District Court Judge William Conley held that the law imposed unconstitutional burdens on the right of Wisconsin women to access abortion services, that the imposition of those burdens, rather than any attempt to promote women's health, was the Legislature's unconstitutional intent when it passed the law and that the law impermissibly and unconstitutionally delegated to private institutions with no right of appeal to the state the decision of whether to award admitting privileges. CWPB Successfully Defends the Constitutional Authority of State Superintendent of Public Instruction

The Wisconsin Court of Appeals, in a case successfully argued by Lester Pines, Susan Crawford & Tamara Packard, affirmed a circuit court decision that held unconstitutional provisions of a 2011 law that transferred the ultimate authority to oversee the development administrative rules governing education from the non-partisan elected Superintendent of Public Instruction to the Governor. Sanctions for Frivolous Case Upheld

In a case defended by Pines Bach partner Lester Pines, the Wisconsin Court of Appeals upheld a circuit court order that imposed monetary sanctions on the plaintiff, Minerals Development & Supply Company, Inc., and its attorneys for having brought and maintained a frivolous lawsuit in the case of Minerals Development & Supply Company, Inc. et al v Hunton & Williams, LLP, et al. The Court also upheld the revocation of one attorney's pro hac vice admission to practice in Wisconsin. Read the full decision here.
